Rules for using the Pocket Trotter platform

1. Purpose and acceptance

These Terms of Use (“Terms”) govern access to and use of the Pocket Trotter platform (the “Service”). By accessing the Service or creating an account, you accept the Terms. If you do not accept them, you must not use the Service.

The premium subscription is additionally governed by the terms of sale.

2. Description of the Service

Pocket Trotter lets you import, clean, view and share GPX tracks of outdoor activities, with points of interest along the route, weather planning (premium) and public publishing of itineraries.

There are three access levels: anonymous visitor (browsing, with part of the POIs hidden), free account (importing and managing your routes, favourites) and premium subscription (advanced features, see terms of sale).

The Service is available through a website and an Android mobile app. The premium subscription can be taken out on the web (Stripe payment) or in the Android app (purchase via Google Play); see the terms of sale.

3. Access and account

  • Account creation is done via Google sign-in (OAuth). You warrant the accuracy of the information provided.
  • You are responsible for keeping your access confidential and for activities carried out from your account.
  • An account is personal. You agree not to impersonate any third party.
  • You may delete your account at any time; deletion entails erasure of the associated data as set out in the privacy policy.

4. Your content (GPX tracks and descriptions)

You retain full ownership of the GPX files and descriptions you upload (“Content”). You warrant that you hold the necessary rights to this Content and that publishing it infringes no third-party right or law.

Solely for the purposes of the Service, you grant the publisher a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (technical optimisation/simplification of tracks) and display your Content. This licence ends when the Content or the account is deleted, subject to temporary backups and content already shared/downloaded by third parties.

Publicly published routes

A route you make public becomes accessible to everyone, may be indexed by search engines, shared and downloaded. Mind your privacy: do not publish tracks revealing your home or sensitive data about you or third parties.

5. Prohibited behaviour

You agree not to:

  • upload unlawful, misleading, defamatory or infringing content, or content harming third-party rights;
  • upload malicious files or attempt to exploit vulnerabilities (injections, XXE/XSS, etc.);
  • disrupt, overload or circumvent the Service's security mechanisms, quotas or rate limiting;
  • mass-extract (scrape) the Service's data or reuse it in breach of applicable licences (notably OpenStreetMap/ODbL);
  • impersonate others or collect other users' data.

6. Service intellectual property

The Service (interface, trademarks, logos, software, databases) is protected by intellectual property law and remains the publisher's property. Pocket Trotter® is a trademark registered with the French Intellectual Property Office (INPI). Nothing in the Terms grants you any right to these elements beyond the normal use of the Service.

Map and point-of-interest data come notably from OpenStreetMap (© OpenStreetMap contributors, ODbL licence); reuse is subject to these licences.

7. Availability and changes

The Service is provided “as is” and “as available”. The publisher may evolve it, temporarily suspend it (maintenance) or change its features. It guarantees neither uninterrupted nor error-free operation.

8. Suspension and termination

In the event of a breach of the Terms, the publisher may, after notice where possible, suspend or terminate access to the account. Ongoing subscriptions are handled in accordance with the terms of sale.

9. Liability — outdoor activities

Safety: your responsibility

Routes, points of interest and weather data are provided for indicative purposes and may contain inaccuracies. You are solely responsible for planning your outings, choosing your routes, checking actual conditions on the ground, your equipment and your safety. Never rely exclusively on the app.

To the extent permitted by law, the publisher cannot be held liable for damage resulting from use of the Service or the information it provides. These Terms do not limit the mandatory statutory warranties applicable to consumers.

10. Personal data

The processing of your data is described in the privacy policy, compliant with the GDPR.

11. Changes to the Terms

The publisher may amend the Terms. The applicable version is the one in force when you use the Service; the update date appears at the top of the page. In the event of a substantial change, you will be informed by appropriate means.

12. Governing law and disputes

The Terms are governed by French law, without prejudice to the mandatory protective provisions applicable in your country of residence if you are a consumer. For purchases, a consumer-mediation scheme applies (see terms of sale).
